Terms of Service
Accepting these terms
These terms are an agreement between you and Kovert Watch ("we", "us"). By creating an account or using the Kovert Watch apps or website, you agree to them and to our Privacy Policy. If you do not agree, do not use the service. You must be at least 18 years old, or the age of majority where you live.
The service
Kovert Watch sends notifications about events reported by your vehicle's Sentry Mode, and offers related features such as an activity feed and, if you turn them on, schedules and a deterrent. It depends on your vehicle, its software, your phone, your internet connection and services run by Tesla, Apple and Google. We may add, change or remove features, and we will give notice of material reductions to paid features where we reasonably can.
Kovert Watch is independent. It is not affiliated with, endorsed by or sponsored by Tesla, Inc. Tesla and its product names are trademarks of Tesla, Inc.
Not a safety or security guarantee
Alerts can be delayed, missed or wrong. Causes include loss of mobile or internet coverage, a sleeping or offline car, changes or outages at Tesla, Apple or Google, phone settings such as Focus modes or battery saving, and bugs. Never rely on Kovert Watch where a missed or late alert could put a person at risk or cause loss you cannot accept. In an emergency, contact local emergency services.
Your account and Tesla access
- You must own or be authorized to use the vehicle you connect.
- You approve our access on Tesla's own sign-in page. You can revoke it at any time in your Tesla account or by removing our virtual key from the car.
- Keep your phone and accounts secure. You are responsible for activity under your account.
- Tesla's terms and policies apply to your use of Tesla's services. Tesla may change or restrict access to its services, which may affect Kovert Watch.
Subscriptions and billing
- Paid features require a subscription, currently $2.99 per month or $29.99 per year, in US dollars, before any taxes. New subscribers get a 7-day free trial; you are charged when it ends unless you cancel first.
- Subscriptions are billed and managed by Apple or Google. Payment, renewal, cancellation and refunds follow their rules. Subscriptions renew automatically until you cancel at least 24 hours before the end of the current period.
- Cancel in your Apple or Google subscription settings. Deleting the app does not cancel the subscription.
- We may change prices with advance notice. Changes apply from your next renewal after the notice, and you can cancel before then.
- Promotional offers, such as beta tester vouchers, have the terms stated when offered, have no cash value, and can be changed or withdrawn if abused.
Acceptable use
You agree not to:
- use Kovert Watch to track, monitor or harass anyone, or to access a vehicle you are not authorized to use;
- break the law, or violate others' rights, including privacy and recording laws that apply where your car is parked;
- attempt to interfere with, overload, reverse engineer or gain unauthorized access to our systems, or to bypass limits or billing;
- resell or share access to the service without our permission.
Recording laws differ by place. You are responsible for how you use Sentry Mode and any clips it records.
Deterrent features
If you turn on an optional deterrent (flashing lights or honking), you are responsible for where and when it activates. It may be noisy, may disturb others, and may be restricted by local noise rules. It is off by default. Do not rely on it to prevent theft or damage.
Ownership
We own the Kovert Watch apps, website and brand. We give you a personal, limited, non-transferable license to use the apps for their intended purpose while you comply with these terms. You keep your own data, and you give us permission to process it as needed to provide the service as described in our Privacy Policy.
Disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the service will be uninterrupted, timely, secure or error free, or that alerts will always arrive.
Limits of liability
To the fullest extent the law allows, Kovert Watch and its owners and contractors will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, vehicle contents or vehicle damage, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US $50 if you paid nothing. Some places do not allow some of these limits, so they apply only as far as the law permits.
Ending your use
You can stop using Kovert Watch and delete your data at any time. We may suspend or end access if you break these terms, if the law requires it, or if we stop offering the service, and we will give reasonable notice where we can. Sections that by their nature should continue, including disclaimers and limits of liability, will survive.
Governing law
These terms are governed by the laws of Germany, without regard to conflict rules, and disputes will be handled in the courts of Berlin, Germany, unless your local consumer law says otherwise.
Changes
We may update these terms. We will change the date above and, for material changes, tell you in the app or by email. Continuing to use the service after changes take effect means you accept them.
